Boat Crash Update: No Blood Kit Results, No Charges
It could be months before charges are filed in the August boat accident on the Magothy River involving state Delegate Don Dwyer.
Many people don't understand why charges weren't filed on the spot following the Aug. 22 boat accident on the Magothy River.
The investigation isn't taking any longer than it typically does for a "serious boat accident," according to a spokesman for the Maryland Natural Resources Police (NRP). But the public's interest in the investigation is high because of the involvement of state Delegate Don Dwyer (R-Pasadena).
Seven people were injured—including children—and transported to area hospitals on the night of the accident.
"When NRP arrived at the boat accident Del Dwyer was involved in, all the witnesses were gone, the boats were gone, and the victims were gone," wrote Sgt. Brian Albert, spokesman for the NRP, in an email to Patch.
The day after the incident, Dwyer admitted to drinking on the night of the boat crash. However, Albert said that the blood analysis kit is still not back to confirm reports that said Dwyer's blood alcohol content was 0.2.
It wasn't a typical accident scene since it was cleared when NRP arrived.
"When we have subjects on scene, NRP officer do charge on the same night or time frame as with a DWI in a vehicle, when the operater either agrees to a breath test or refuses," Albert wrote in an email.
In this case, NRP will have to wait for the blood kit results and the completion of the investigation before filing charges. Albert told Patch that charges will likely be filed in December, but could also happen in early January 2013.

"Many people don't understand why charges weren't filed on the spot following the Aug. 22 boat accident on the Magothy River."
That is an understatement.
"In this case, NRP will have to wait for the blood kit results ......"
How long does it take for blood test results to come back if you are not an elected official?
This case disgusts me.

EVERYONE should be held accountable for illegal or inappropriate behavior... Including politicians. Just like Obama Care.....Why dont they have the same insurance plan if its so darn great???? Why cant we get the treatment that the government officials will get???? Its just wrong thats all.....

First of all Dan Im not old and angry ..... Its NOT about affordable health care!!! It IS about favoritism towards politicians and members of the government. Are you blind or do you just enjoy being placed on the shelf with the "all you guys get screwed" catagory? The damn drunk deserves jail like any other joe blow that drives a boat around drunk like a fool injuring other people and their children. What if it were your family??? As far as affordable health care???? Are you kidding me! you believe cutting the health care of the elderly that brought you here and got you where you are today is worth making health care affordable? They need to start with real and honest mandates in the FDA and stop allowing big money companies from producing chemical infested foods and labeling them safe and marketing them..... Half of what is approved as safe is nothing more then cancer causing chemical. We are one the most advanced countries in the world medically and technologically and we are the sickest. We consume more pharmaceuticals then any where else in the world. Its all about clean air and clean water and we allow the FDA to put death sentence products on the shelves daily......Yea let the good man off the hook what the heck right??? He serves us right??? What a crock of crap. Its a dark dark world thats only gonna get worse without some honest accountability and change of heart....which is very unlikely to happen anytime soon. Old and angry???? Nahhh!!!! Just fed up and disgusted!

The big question? If DNR did not get a blood sample at the time of the accident and cannot use the hospitals 0.2 blood sample. How many hours went by before DNR got there blood sample? It is my understanding A person loses .04 BAC per hour. Meaning Dwyer may have been 0.3 or above at the time of the accident!!! And 0.08 or less the time DNR got her blood sample. This case is B.S.

I am disgusted on why we need to wait. By now they should have blood test is hand. It is starting to look like another cover up. I can not imagine
why it is taking so long. Note Dwyer does commercials with the people doing the investigation and it is also time for election. Go figure. The longer you wait the better of you are. What about the families involved???? Where is the justice!!!!! Do
rof the children and the families and how it affected everybody

This has slimy crooked cover up written all over it. The people of our community should be outraged! Would love to be able to get the statistics as to how many DWIs were given out over the summer to boaters and how long it took to actually issue the DWI. Are we really going to sit by and let him get away with this? How can anyone in our area have ANY faith, trust or respect for the NRP???? I used to see them as a valuable resource and now I just seem them as dirty crooks. I'm embarrassed for our community :(

Just heard they are FINALLY pressing charges. Excessive speed and DWI. I'm sure he'll get off both but at least he's getting charged!
