No Charges Yet in Boat Accident Involving Dwyer

Seven people were hospitalized, including state Delegate Don Dwyer, when two boats collided on the Magothy River near Gibson Island last month.

Although it's been more than a month since Delegate Don Dwyer (R-Pasadena) admitted to drinking on the night of a boat crash on the Magothy River, no charges have been filed in connection to the incident.

On the evening of Aug. 22, Dwyer's boat reportedly collided with another boat that had two adults and five children on board near Gibson Island. Maryland Natural Resources Police (NRP) said seven people were hospitalized, including at least four children.

Key evidence in the case will be the results of a toxicology screen for both boat drivers. Sgt. Brian Albert, a NRP spokesman, confirmed earlier this week that the results aren't in yet.

Patch previously reported that Dwyer held a press conference the day after the crash and acknowledged drinking before operating the vessel.

"It is true that I was drinking while I was operating my boat ... It's also been reported that my blood alcohol content was 0.2," he said during the press conference. "No one, no one should be drinking and operating a motor vehicle or power boat. I deeply regret my actions and ask for forgiveness from the public."

Just like driving under the influence, the legal blood alcohol content limit for operating a vessel is 0.08—if Dwyer's was truly 0.2, it was more than twice the legal limit.

Albert previously told Patch via email that "NRP will complete a thorough investigation prior to charges being placed. Also, blood kit analysis usually take approximately 30 days to return results."

The delay in the filing of charges could be due to the ongoing investigation and interviews with witnesses that may not be completed until October, The Baltimore Sun reported.

Penalties in Maryland for being found guilty of boating under the influence could include fines, imprisonment, community service, loss of boating and driving privileges, and counseling for alcohol or substance abuse.

So if I had a BAC more than double the legal limit and sent 7 people to the hospital from ANY vehicle accident, I wouldn't be charged? Wow. WHAT A COUNTRY!

Sounds like political cover-ups at it's Best! As always protect the politicians they can do no wrong? This man is helping pass our Laws. Where are the MAD women, they should be asking for his Head!

Gotta love American politics, yes? One thing I haven't heard much of anything about, and fogive me if I over-step my bounds on free speach here, but what about Mr. Moran who was also on Dwyer's Baja? Here we have an officer who is supposedly dedicating his career ... his life... to serving others and upholding the law, doesn't he have an obligation as a passenger on the boat to give a witness statement...............at the very least? But instead, what happened (according to witnesses..) IS THAT HE BAILED! And, what's incomprehensible to me, is thatvhe did this WHEN THERE WERE CHILDREN IN THE WATER, CRYING AND IN NEED OF HELP!.! What he DID do, was call a friend, get on their dingie, and was found four hours later, bloody and in need of treatment (which he refused) "hiding" out in Mr. Dwyer's boathouse. Am I the only one here who is OUTRAGED by this???? Somebody, anybody, if you have any thoughts or feelings about this one's behavior, please acknowledge......

If it were YOU or I or any body else, we would be charged with DUI DWI speeding reckless endangerment ETC. or any other charges that they could come up with. after DNR does their investigation and turned over to the States Attorney they will then add or eliminate charges that they found out in their investigation. the moral of of this statement is it sucks that people in high places get special treatment. not to mention it's been a month and a half and Mark Moran was his passenger that recently ran too to be the sheriff . WOW how come nobody has been arrested or put in jail

Once again after reading the latest in the Baltimore Sun I am left to be outraged. How is it that DNR needs another 2 months going in to the year 2013 to complete their investigation. Has anybody ever asked the question, How many hours went by before DNR did there blood test??? Meaning every hour that passes from the time of the boat accident a person loses .04 every hour, which means DWYER may have been in the .3 or the .4 range at the time of the accident. Then you have Mark Moran a 2 or 3 time candidate for Sheriff and County Council that was hiding in DWYERS garage that refused service and comments. not to mention Captain Jerry's Kirkwoods spokesperson for DNR crazy statements such as " Though DWYER was drinking, it doesn't mean he's to blame". " Hey, he admitted to drinking so it must be his fault". I would a not rush to judgement". Kirkwood was not sure what a rouse investagators suspicions." it could have been as simple as a crushed up beer can" or the smell of alcohol. Did Captain Kirkwood mention he has done at least 1 commercial maybe more with DWYER???

Would anyone else be interested in forming a protest at DNR headquarters re: this? If so, I'm in. This is outrageous! Are we as a community really going to let them get away with this??? It's been FOUR Months. This is dirty politics at it's best! :( :(
